These Terms of Service (“Terms”) govern your access to and use of the products, services, and website (collectively, the “Services”) provided by AiRysk Inc. (“AiRysk,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing the AiRysk platform, deploying the AiRysk browser extension or endpoint agent, or otherwise using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

AiRysk provides an enterprise AI observability and security platform that enables organizations to monitor, detect, and govern AI interactions across their workforce. Our Services include:

  • The AiRysk cloud platform (web portal and API)
  • The AiRysk browser extension for AI interaction capture
  • The AiRysk endpoint agent for device-level monitoring and data protection
  • Sensitive data detection, redaction, and alerting capabilities
  • Organization memory, guardrails, and policy enforcement features
  • Industry-specific agent modes and reporting

3. Account Registration and Security

To use certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration, maintain the security of your account credentials, promptly notify us of any unauthorized access to your account, and accept responsibility for all activity that occurs under your account.

4. Enterprise Customer Responsibilities

If you are an enterprise customer deploying AiRysk within your organization, you are responsible for:

  • Obtaining any required consents from your employees or end users prior to deploying AiRysk monitoring capabilities
  • Configuring monitoring scope, data retention, and access controls in accordance with applicable laws and your internal policies
  • Ensuring that your use of AiRysk complies with all applicable local, state, national, and international laws and regulations
  • Managing user access and permissions within the AiRysk platform

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party rights
  • Monitor individuals without proper legal authority or required consent
  • Attempt to gain unauthorized access to any part of the Services or related systems
  • Reverse engineer, decompile, or disassemble any portion of the Services
  • Transmit malicious code, viruses, or other harmful content
  • Resell, sublicense, or redistribute the Services without our prior written consent

6. Intellectual Property

All rights, title, and interest in and to the Services, including all software, algorithms, models, user interfaces, designs, trademarks, and documentation, are and remain the exclusive property of AiRysk Inc. These Terms do not grant you any rights to use our trademarks, logos, or brand features without our prior written consent.

You retain all rights to your data. AiRysk does not claim ownership of any data you submit to or process through the Services.

7. Data Ownership and Processing

Enterprise customers retain full ownership of all data collected, processed, and stored through the Services. AiRysk processes customer data solely to provide the contracted Services. We do not use one customer's data to train models that serve other customers. We do not sell customer data to any third party under any circumstances.

8. Service Availability and Support

We strive to maintain high availability of our Services but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, updates, or modifications to the Services. We will make reasonable efforts to provide advance notice of planned downtime. Support is available via email at support@airysk.com.

9. Fees and Payment

Certain features of the Services may require payment of fees. Fees are specified in your subscription agreement or order form. All fees are non-refundable unless otherwise stated in your agreement. We reserve the right to modify pricing with reasonable advance notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AiRysk Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunity, arising out of or relating to your use of the Services, regardless of the theory of liability.

Our total aggregate liability for all claims arising under these Terms shall not exceed the amount you paid to AiRysk for the Services during the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AiRysk does not warrant that the Services will detect all sensitive data, prevent all data leakage, or be free of errors.

12. Indemnification

You agree to indemnify, defend, and hold harmless AiRysk Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access to the Services immediately if you breach these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, third parties, or AiRysk. Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination shall remain in effect.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new “Last Updated” date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
